TEXAS COURT OPENS THE DOOR FOR TAX-FUNDED ABORTIONS - ATTORNEY GENERAL FIGHTS BACK

In a surprise move the Third Court of Appeals of Texas struck down a ban on abortion funding that had existed since 1977. Pro-life Attorney General John Cornyn led the Texas defense against the Plaintiffs, all abortion providers, and their attorneys from the Center for Reproductive Law and Policy.

The Court cited the Texas Equal Rights Amendment as a basis for the decision to allow Medicaid abortions for low-income women, saying that when the state chooses to provide medically necessary services to indigent persons, it must not discriminate on the basis of gender, including pregnancy.

Approximately 1.4 million women of childbearing age and countless numbers of their children are affected by this decision. Texas would certainly see a reversal in the recent trend away from abortion. Touted as a compassionate decision, the move really means that vulnerable women will be pressured to agree to a free abortion. Since no federal dollars are earmarked under Medicaid for abortions, Texas taxpayers would be forced to pick up the whole tab. The message is that poor women and their children are not welcome in Texas.

Attorney General Cornyn immediately moved to appeal this decision to the State Supreme Court, which came as no surprise to pro-lifers. He is a longtime friend of the prolife community in Texas. In addition to notifying schools throughout the state that abstinence-only education is now the law of the land, you will also recall that Cornyn has been working on our behalf to protect the Legislature's intent regarding our new parental notification law. Many of you have even helped us with our petition drive to support the Attorney General in his courageous response to judges of the court.
